Pérez-Llorca and CEOE: Collective and Individual Dismissal Trends

Pérez-Llorca and CEOE recently organized a seminar to address the latest developments in the legal framework governing collective and individual dismissals. The event explored key challenges stemming from European Union and Spanish Supreme Court case law, focusing on balancing workers’ rights with business needs to foster greater understanding among stakeholders.

The session opened with remarks from Luis Enrique Fernández Pallarés, Partner at Pérez-Llorca; Rosa Santos, Employment Director at CEOE; and Yolanda Valdeolivas, Of Counsel at Pérez-Llorca. Santos emphasized the importance of the Fifth Agreement for Employment and Collective Bargaining (V AENC) as a milestone in bipartite social dialogue, while Valdeolivas noted the need for a more thoughtful legislative approach amid “regulatory stress.”

The program included two panels: one on collective dismissals, moderated by Valdeolivas, with experts including María Luisa Segoviano Astaburuaga, Constitutional Court Magistrate; and another on individual dismissals, led by Fernández Pallarés, featuring judicial and corporate perspectives.

Panelists discussed legal uncertainties, legislative improvements, and practical solutions to enhance regulatory clarity. Proposals included reforms to consultation periods, judicial limits on retroactive rulings, and measures to streamline compensation in restructuring cases.

The event underscored the importance of aligning labor regulations with judicial and legislative developments to ensure legal certainty and effective labor relations.
