GA_P advises Cabify Group on the Prejudicial Matter C-50/21
Gómez-Acebo & Pombo has advised Prestige and Limousine, one of the companies of the Cabify Group specialized in transportation, in Prejudicial Case C-50/21.
The GA_P team has been led by Borja Carvajal, Pedro Soto and Álvaro Obregón, partner, of counsel and associate of the public and regulatory team.
This has been resolved by the Court of Justice of the European Union in its Judgment of June 8, in which certain restrictions on VTC services provided for in the regulations approved by the Metropolitan Area of Barcelona were found to be contrary to European Union Law.
The Court of Justice of the European Union ruled, among other issues, that the limitation of VTC licenses in the Metropolitan Area of Barcelona (1/30 rule) is contrary to European law, considering that it violates the principle of freedom of establishment regulated in Article 49 of the Treaty on the Functioning of the European Union.
