Cuatrecasas advises Daimler on its court victory at the CJEU
Cuatrecasas advised Daimler, together with Gleiss Lutz, on its legal victory before the CJEU, which, in its recent judgment of 16 february, established limits to the assessment of damages by national courts in follow-on liability actions for damages arising from a cartel and confirmed that the Spanish rule on costs is not contrary to EU law.
The issue which gave rise to this judgment was referred to the CJEU in the context of proceedings in Spain for damages against Daimler in connection with the so-called truck cartel.
The judgment states that the judge cannot replace the plaintiff when the plaintiff remains inactive and that it is reasonable for the plaintiff to bear its costs or part of them when the claim is only partially successful.
