ECIJA advises Inetum and secures a €1.5m contract after filing a special appeal in procurement
ECIJA has advised Inetum Spain on filing a special appeal in procurement matters before the Administrative Court for Public Contracts of the Autonomous Community of the Canary Islands, within the framework of the procedure for awarding the contract for technical office support services for the deployment and support of Microsoft solutions for the Canary Islands Tax Agency.
Inetum was initially assessed as the bidder that had submitted the best proposal. However, following a special appeal by the second-ranked bidder, the contracting authority awarded the contract to the latter.
In a joint effort between the company and ECIJA’s Public and Regulatory Law department, a special appeal was filed in the area of public procurement, highlighting a series of irregularities in the procedure that needed to be corrected, thereby reversing the outcome of the tender.
The same Canary Islands court has now upheld the appeal filed by Inetum, annulling the initial award and ordering the exclusion of the winning bidder’s bid for failing to meet essential requirements of the tender specifications, particularly in terms of solvency and subcontracting. The ruling reverses the outcome of the tender procedure, awarding the contract to Inetum, with an estimated value of €1.5 million.
