Kepler-Karst successfully obtains a declaration of commencement of the insolvency proceedings of Abuntia Services

Kepler-Karst has achieved a new milestone in the Wenance and Abuntia case, in which it represents more than 200 victims – out of a total of more than 1,000 injured parties – for an alleged swindle, when the Magistrate in charge of the Commercial Court No. 4 of Madrid, on April 19, 2024, ordered the opening of the insolvency proceedings of Abuntia Services, agreeing the suspension of the exercise of the powers of administration and disposition of the assets and rights that make up the active mass, with all the effects.

It also ordered the appointment of the Insolvency Administrator, appointing ETL BUREAU AUDITORES, represented by Mr. Íñigo Gutiérrez Allúe, who must make the communications to the creditors, public bodies and workers’ representatives. The decision adopted by the Magistrate indicates that the economic data of Abuntia show a situation of current insolvency, since its balance sheet, as of December 31, 2023, shows that the current assets are -9,261,870.45 euros and the current liabilities are 77,535.25 euros.

The Kepler-Karst team is led by partners Davinia Sánchez de la Cruz and María Bartle (both pictured), specialists in insolvency law, who are supported by the Argentine consulting lawyer Fabián Medizza, among others, and by the Of Counsel, Eduardo de Urbano and Víctor Miranda, of economic criminal law.
