CMS advises Nebeus on MiCA licence from CNMV

Nebeus, a crypto-financial platform based in Barcelona, has secured authorisation as a Crypto-Asset Service Provider (CASP) from Spain’s Comisión Nacional del Mercado de Valores (CNMV) under the European Union’s Markets in Crypto-Assets (MiCA) Regulation. The company received legal advice from CMS Albiñana & Suárez de Lezo throughout the process.

The authorisation comes shortly after the expiry, on 30 June, of the transitional period established under the MiCA Regulation. The new European framework harmonises the provision of crypto-asset services across the EU and has required companies in the sector to adapt their governance structures, internal procedures and control systems to meet the new regulatory requirements. According to the release, only a limited number of operators managed to obtain the corresponding authorisation before the transitional regime expired, reflecting the technical and regulatory complexity of the process. Nebeus is among the Spain-based crypto-financial platforms to obtain this authorisation, following eleven years of operations from Barcelona with global reach.

The team

CMS supported Nebeus throughout the authorisation procedure before the CNMV, providing specialised advice on the regulatory documentation required, the organisational and corporate governance requirements set out under MiCA, and the various legal and regulatory aspects necessary to obtain the licence.
