Clyde & Co partners with FASE on MGA regulation in Europe
Clyde & Co, an insurance law firm, has signed a collaboration agreement with the Fédération des Agences de Souscription Européennes (FASE), the pan-European federation representing Managing General Agents (MGAs), to provide analysis and technical expertise to its members in managing their regulatory obligations across different European markets.
MGAs—composed of entities that underwrite risks on behalf of insurers under delegation agreements—operate in an environment characterised by substantial differences between jurisdictions and increasingly technical supervision. Although European insurance regulation is based on harmonised directives, their practical application varies between Member States, particularly in areas such as cross-border distribution, corporate governance and oversight of delegated activities.
In this context, Clyde & Co will make its experience advising MGAs and insurers providing capacity in Europe available to FASE members, with a particular focus on regulatory developments, supervisory practice and emerging risks affecting the sector, states the law firm.
The collaboration will include the development of an interactive European regulatory map for MGAs, offering a structured, country-by-country overview of the main supervisory authorities and regulatory frameworks affecting delegated underwriting activities. The tool will help identify key differences between jurisdictions and support strategic decision-making in expansion processes or reviews of existing structures.
In addition, as part of the two-year agreement, Clyde & Co will produce a European MGA report based on its established UK market publication. The report, scheduled for publication next year, will analyse the main regulatory and market trends affecting MGAs across continental Europe.
“In our experience, regulatory differences between countries are not always found in the written rules, but in how they are supervised and interpreted. Anticipating those differences is essential to designing robust delegation models from both a legal and operational perspective,” explain Enrique Navarro and Miguel Relaño, co-managing partners of Clyde & Co in Madrid (both pictured from left to right).
William Pitt, Chief Executive Officer of FASE, adds: “We are delighted to be able to share the knowledge and experience of Eva-Maria Barbosa, partner at Clyde & Co in Munich and coordinator of this project, to help our members navigate a regulatory environment that is often complex at both national and international level.”
Clyde & Co will participate on 11 and 12 May in the inaugural FASE Rendezvous conference in Barcelona, where it will share its insights with industry leaders on the regulatory evolution of delegated underwriting in Europe. This collaboration forms part of Clyde & Co’s integrated European insurance practice, with nine offices in France, Germany, Ireland, the Netherlands, Poland and Spain, and builds on the firm’s extensive experience supporting MGAs in the UK market.
